Making Your Own Decisions

As young people develop, and increasingly form their own views, they should be involved more and more closely in decisions about their own future. After compulsory schools age (16), the right to make requests and decision applies to them directly, rather than to their parents.

Parents, or other family members, can continue to support young people in making decisions, or act on their behalf, provided that the young person is happy for them to do so.

Support for young people

Some young people will need support from an independent skilled supporter to ensure their views are acknowledged and valued.

For more information, please contact SEND Information, Advice and Support Service (SENDIASS, Carer’s Hub) by telephone 020 8593 4422 or by email carers@carerscentre.org.uk

The Mental Capacity Act 2005

The principle of this Act is to ensure that those who lack capacity are empowered to make as many decisions for themselves as possible, and that any decision make, or action taken on their behalf is done so in their best interests.

Further guidance can be found in SEND Code of Practice Annex 1, Mental Capacity.
